1.1. This website is owned and operated by the Australian Livestock Export Corporation Ltd (“LiveCorp”, ABN 88 082 408 740). LiveCorp trades at Level 1, 40 Mount St, North Sydney, NSW Australia 2060.

1.2. “We” or “us” refers to the LiveCorp and its employees and contractors.

1.3. “You” or “your” means a user of this website including, in the case of any minor, the minor’s parent or legal guardian.

1.4. Your access to this website is subject to these terms and any additional terms, conditions, notices and disclaimers which appear on this website (“Terms of Use”). By using this website, you confirm that you accept the Terms of Use and agree to comply with them. If you do not accept the Terms of Use, you must refrain from using the website.

1.5. LiveCorp may alter these Terms of Use from time to time without notice. You should review the Terms of Use regularly. Amendments will be effective immediately upon notification on this website. Your continued use of the website following those changes indicates your acceptance of those changes.

2.1. All rights (including intellectual property rights such as copyright) in this website, its content and design are owned by or licensed to LiveCorp. All rights are reserved.

2.2. Unless we agree otherwise in writing, you are provided with access to this website only for your personal use. You are authorised to print a copy of any information contained on this website for your personal use, unless such printing is expressly prohibited. Without limiting the foregoing, you may not without our written permission on-sell information obtained from this website.

3. Trade marks

3.1. All trade marks, trade names, service marks and other product and service names, not limited to but including LiveCorp’s logo, business name and trading name, are protected by applicable trade mark and copyright laws.

4.1. Nothing in these Terms of Use excludes, restricts or modifies any condition, warranty, right or liability implied in the Terms of Use or protected by law to the extent that such exclusion, restriction or modification would render the Terms of Use or any provision of the Terms of Use void, illegal or unenforceable. Subject to that:

4.1.1. we do not accept responsibility for any loss or damage, however caused (including through negligence), which you may directly or indirectly suffer in connection with your use of this website or any linked website, nor do we accept any responsibility for any such loss arising out of your use of or reliance on information contained on or accessed through this website;

4.1.2. any condition, warranty, right or liability which would otherwise be implied in the Terms of Use or protected by law is excluded; and

4.1.3. except in relation to liability for personal injury (including sickness and death), we do not accept liability to you in respect of any loss or damage (including indirect, special or consequential loss or damage) which may be suffered or incurred by you or which may arise directly or indirectly in respect of goods or services supplied pursuant to or in any way connected with this website or respect of any failure or omission on our part to comply with our obligations as set out in the Terms of Use.

4.2. Where possible, care is taken to ensure the accuracy of all information contained on this website. However, without limiting the generality of clause 4.1. LiveCorp does not accept responsibility for the accuracy or completeness of the information or opinions contained on this website. You should make your own enquiries before making decisions concerning your interests.

5. Use of the website

5.1. You must ensure that your access to this website is not illegal or prohibited by laws which apply to you.

5.2. You must take your own precautions to ensure that the process which you employ for accessing this website does not expose you to the risk of viruses, malicious computer code or other forms of interference which may damage your own computer system. For the avoidance of doubt, we do not accept responsibility for any interference or damage to your own computer system which arises in connection with your use of this website or any linked website.

5.3. Whilst we have no reason to believe that any information contained on this website is inaccurate, we do not warrant the accuracy, adequacy or completeness of such information, nor do we undertake to keep this website updated. We do not accept responsibility for loss suffered as a result of reliance by you upon the accuracy or currency of information contained on this website.

5.4. We do not give you any assurances that any information contained on this website will be suitable for your purposes or that it will be error-free. You agree that you will not rely on any such information or its availability and that any reliance you make will be on your own independent assessments with the aid of qualified independent advice.

6. Industry-only content

6.1. In order to be able to access certain sections of this website and the content contained therein (together, Industry-only Content), you must be an eligible industry member. Eligible industry members are those approved by LiveCorp to access Industry-only Content and include LiveCorp staff and board members, LiveCorp Exporter and Associate Members, ALEC staff, CEO and President/Chair of state LEAs, and LEP staff (Eligible Industry Members).

6.2. LiveCorp will require you to use your username and password to obtain access to the Industry-only Content. You are responsible for maintaining the confidentiality and security of your username and password and for all use or activity that occurs on your account, including unauthorised use or activity.

6.3. You must promptly notify LiveCorp if the confidentiality and security of your username and password is compromised or there is any unauthorised use of your username or password.

6.4. LiveCorp will not be responsible for any losses arising from the unauthorised use of your username or password.

6.5. LiveCorp reserves the right to disable, temporarily or permanently, any username or password at any time, including if, in LiveCorp’s reasonable opinion:

6.5.1. the purpose for, and conditions on, which you were granted access to the Industry-only Content no longer apply;

6.5.2. you have failed to comply with any of the provisions of the Terms of Use; or

6.5.3. it is no longer appropriate for you to have access to the Industry-only Content.

6.6. From time to time, and in its sole discretion, LiveCorp may reset your password or the passwords of all Eligible Industry Members. Should this occur, you will be prompted to set a new password during your next login attempt.

7. Collection of information

7.1. LiveCorp may make a record of your visit and log your visit for statistical and business purposes. Such information may include, but is not limited to, your server address, domain name, IP address, the date and time of your visit, pages accessed, documents downloaded, previous sites visited and the type of browser used. Where that information constitutes your personal information, LiveCorp will only use that information in accordance with its Privacy Policy.

7.2. If LiveCorp requires you to complete an electronic form on this site and in doing so it requires you to enter personal information, LiveCorp will provide you with information concerning that collection and will only use that information in accordance with its Privacy Policy.

8. Cookies

8.1. This website uses “cookie” technology to assist in identifying registered users and delivering contents specific to your interest. Cookies are pieces of information stored on an individual’s computer and are used for customising site information to improve user experience and for tracking user navigation.

8.2. If you do not wish information to be gathered on a cookie you should disable the acceptance of cookies by your web browser. Your Internet Service Provider may be able to assist you. However, this may limit or prevent your ability to access content on this site.

10.1. Unless we agree otherwise in writing, we give no licence to exercise any intellectual property rights in anything (including information and content such as films, sound recordings, literary works and artistic works, whether in a material form or not) on or accessible via this website (“materials”). Without limiting the preceding sentence, any uses or disclosures (including reproductions and communications to the public) of any materials by you and by any controlled persons must be subject to you:

10.1.1. ensuring that those uses and disclosures are undertaken at your and their own risk, including the risk of being sued for intellectual property infringement or misleading or deceptive conduct;

10.1.2. ensuring that all links to any materials are never presented or useable in a way where the presentation or use of the link does not make it obvious to a viewer or user of the links or linked materials that the source of the materials is this website;

10.1.3. ensuring that anyone who may use your links or the links of any controlled persons to the materials are persons who would be entitled to access the materials directly from this website; and

Whilst we strive to protect such information, we do not warrant and cannot ensure the security of any information which you transmit to us.
